FuturENVIRO PROYECTOS,TECNOLOGÍAYACTUALIDADMEDIOAMBIENTAL | ENVIRONMENTALPROJECTS,TECHNOLOGYANDNEWS Número 82 • Julio-Septiembre 2021 | Issue 82 • July-September 2021 PUBLIC CONSULTATION PERIOD OPENS FOR ROYAL DECREE ON PACKAGING AND PACKAGINGWASTE As this issue of FuturENVIRO goes to press, the Ministry for Ecological Transition and Demographic Challenge (MITECO) has today (September 28, 2021) opened the period of public consultation for the draft Royal Decree on packaging and packaging waste. This draft legislation transposes the last of the pending 2018 European Circular Economy Package directives and applies the precepts of the Single-Use Plastics Directive to packaging. It also amends the extended producer responsibility system for packaging, in accordance with the provisions of theWaste and Contaminated Land Bill currently going through the Spanish Parliament. Prevention is the first priority in the waste hierarchy. For this reason, the draft Royal Decree applies the reduction targets set out in the Spanish Circular Economy Strategy to packaging waste. It sets a specific target of halving the consumption of single-use plastic bottles by 2030, taking the year-two data recorded in the new packaging section of the Product Producers Register as the benchmark. The draft legislation also incorporates EU packaging waste recycling targets, including both overall targets (65% by 2025 and 70% by 2030) and the targets set for specific materials. To promote recycling and the use of quality secondary raw materials in the manufacture of new packaging, particularly plastic packaging, the draft Royal Decree establishes that packaging of this type must contain a minimum percentage of recycled plastic. The draft legislation makes it mandatory to give details on the packaging of the material used, its recyclability, the proportion of recycled material it contains, as well as to indicate the appropriate bin in which the packaging waste is to be deposited. If applicable, details of the corresponding Deposit Return System or collective management system should also be provided on the packaging. Moreover, the Royal Decree introduces measures to promote the eco-design of packaging and it is a pioneering piece of legislation in this respect. Síguenos en | Follow us on: www.futurenviro.es | Julio-Septiembre July-September 2021 5 Esperanza Rico Directora EL RD DE ENVASES Y RESIDUOS DE ENVASES A INFORMACIÓN PÚBLICA Hoy 28 de septiembre de 2021, al cierre editorial de este especial de FuturENVIRO, el Ministerio para la Transición Ecológica y el Reto Demográfico (MITECO) ha abierto a información pública el proyecto de Real Decreto de envases y residuos de envases. Este proyecto normativo, transpone la última de las directivas pendientes del paquete europeo de economía circular de 2018, aplicando los preceptos de la Directiva de plástico de un solo uso a los envases y revisando el régimen de responsabilidad ampliada del productor a los envases, según lo recogido en el Proyecto de Ley de Residuos y Suelos Contaminados que se está tramitando en el Congreso de los Diputados. La prevención es la prioridad en la jerarquía de residuos. Por ello, el proyecto de Real Decreto incorpora los objetivos de reducción incluidos en la Estrategia Española de Economía Circular al flujo específico de los envases y recoge como objetivo concreto en 2030 reducir a la mitad las botellas de plástico de un solo uso, tomando como referencia la información comunicada el segundo año a la nueva sección de envases en el Registro de Productores de Producto. La norma incorpora los objetivos de reciclado establecidos a nivel comunitario para los residuos de envases, tanto globales (65% en 2025 como 70% en 2030) como por materiales. Para fomentar el reciclado y la utilización de materias primas secundarias de calidad en la fabricación de nuevos envases, en especial de los plásticos, el texto incluye que los envases de este material contengan un porcentaje de plástico reciclado. Se establecen también obligaciones de marcado e información de los envases para indicar el material del envase, su reciclabilidad, la proporción de material reciclado y el contenedor donde se han de depositar los residuos de envases, o si procede la identificación correspondiente al SDDR o al sistema colectivo. Además, por primera vez se introducen medidas para impulsar el ecodiseño de envases.
