El año 2020 ha sido todo un reto para el sector de la gestión de residuos industriales y peligrosos, ya que ha permitido que otros sectores esenciales, como el sanitario, el químico, energético o logístico, hayan podido continuar su actividad pese a la pandemia. Asimismo, 2021 se presenta lleno de incertidumbre producto de la crisis económica que lleva pareja la crisis sanitaria y con una serie de hitos que tendrán un fuerte impacto legislativo y fiscal. Durante los peores momentos de la pandemia, los miembros de ASEGRE se han puesto a disposición de la industria para superar esta crisis cumpliendo con todas las garantías de seguridad en su gestión. El rigor a la hora de priorizar las medidas de prevención de contagios del COVID-19 entre los trabajadores de nuestras empresas ha sido una garantía de continuidad y de profesionalidad con un impacto positivo en otros sectores. Y, todo ello, bajo un intenso calendario de novedades legislativas que se irán aplicando a lo largo de 2021. Aplicación del nuevo real decreto de traslado de residuos Dentro de estas novedades está el nuevo real decreto de traslado de residuos. Con esta nueva normativa de traslados se busca mejorar la trazabilidad de los traslados desde el lugar de origen del residuo hasta el destino final. Asimismo, clarifica la tramitación electrónica y facilita la vigilancia y el control de los traslados por parte de las autoridades competentes. Desde ASEGRE esperamos que este real decreto garantice la trazabilidad de la gestión de los residuos desde el punto de producción hasta la instalación específicamente diseñada, para tratarlo de acuerdo con su clasificación y características. También confiamos en que reduzca las cargas administrativas tanto de productores como de los gestores de residuos y que facilite datos reales de producción y gestión que permitan conocer las características de esta actividad. Así se logrará contribuir al cálculo de los objetivos de gestión fijados por la legislación. Para ello, en 2021 deberá estar plenamente operativa la tramitación telemática relacionada con el traslado de residuos. Para que funcione correctamente, es importante que exista un soporte técnico para resolución de incidencias, la disponibilidad del servicio y asegurar la actualización diaria de la base de datos de productores y gestores. 2020 was a challenging year for the industrial and hazardous waste management sector, a sector which has enabled other essential sectors, such as healthcare, chemicals, energy and logistics, to continue their activity despite the pandemic. Moreover, 2021 looks set to be full of uncertainty, due to the economic crisis that has accompanied the health crisis and a series of milestones that will have a strong legislative and fiscal impact. During the worst moments of the pandemic, ASEGRE members have put themselves at the disposal of industry in order to address this crisis, whilst providing all guarantees of safety in their waste management processes. The rigour exercised in prioritising COVID-19 infection prevention measures among the workers of our companies has been a guarantee of continuity and professionalism, and has had a positive impact on other sectors. And all this has been achieved in the context of a wave of new legislation due to come into force in the course of 2021. Application of new Royal Decree on waste shipment This new legislation includes the new Royal Decree on waste shipment, which seeks to improve the traceability of waste shipments from the place of origin to the final destination. It also clarifies electronic procedures, and facilitates the monitoring and control of shipments by the competent authorities. ASEGRE hopes that this Royal Decree will guarantee the traceability of waste management from the point of production to the facility specifically designed to treat it in accordance with its classification and characteristics.We also hope that it will reduce the administrative burdens on both producers and waste managers, and that it will provide real production and management data that will make it possible to know the characteristics of this activity. This will facilitate the calculation of the waste management targets set out in the legislation. To this end, the telematic procedures associated with waste shipment should be fully operational by 2021. For this to work properly, it is important that technical support is in place to resolve incidents, guarantee the availability of the service and ensure that the database of producers and managers is updated daily. Waste Act enactment procedures This milestone in waste shipment legislation establishes a regulatory framework that complements the draft Bill onWaste and Contaminated Land. It guarantees the traceability of the waste bearing in mind that the responsibility of the waste producer will potentially be extended through to final treatment of the waste. Following years of hard work and raising awareness on the part of our sector, Spain is moving towards more professionalised management in which the waste producer will share the responsibility through to final treatment if the traceability of the waste is guaranteed.
