Recientemente el Parlament de las Illes Balears ha aprobado la Ley de Residuos y Suelos Contaminados de las Illes Balears. Un documento pionero a nivel español, del que se han hecho eco otros países, que prohíbe los plásticos de un solo uso; fija cotas para la prevención de residuos y la preparación para la reutilización, así como el pago por generación como herramienta más efectiva para incrementar el reciclaje y costear los servicios relacionados con la gestión de residuos. TARGET: TO MANAGE 800,000 TONNES OF WASTE PER ANNUM IN A DIFFERENT WAY Baleares was the only Autonomous Community lacking a Waste Act. Recently, the Parliament of the Balearic Islands passed the Balearic IslandsWaste and Contaminated Lands Act. This pioneering legislation at national level in Spain, which has been echoed in other countries, prohibits single-use plastics and sets quotas for waste prevention and preparation for reuse. It also establishes a “pay-as-you-throw” system, as the most effective tool to increase recycling rates and pay for services associatedwithwaste management. La primera Ley de Residuos y Suelos Contaminados de las islas fue aprobada hace unas semanas por el Parlament de les Illes Balears con medidas pioneras a nivel estatal, que pretenden luchar contra una problemática que causa estragos ambientales, como el abandono de residuos en el medio natural. Así, la Ley 8/2019, de 19 de febrero, de residuos y suelos contaminados de las Islas Baleares establece objetivos ambiciosos en el campo del reciclaje, la reutilización, la prevención de residuos, el despilfarro alimentario, eliminación de los artículos de un solo uso… “Los objetivos que ha marcado la normativa van más allá de los establecidos por la Comisión Europea y se pretende que, con su aplicación, en 2021 se haya reducido un 10 % de los residuos generados respecto de 2010, y un 20 % en 2030. Para ello, será necesario sustituir con alternativas más sostenibles muchos de los productos de plástico de un solo uso, como las vajillas de plástico, las pajitas para bebidas, los bastoncillos de las orejas y los palillos para caramelos”, explica Vicenç Vidal, conseller de Medio Ambiente, Agricultura y Pesca del Govern de les Illes Balears. A estos productos se han añadido -teniendo en cuenta, así, algunas de las más de 800 aportaciones que ha tenido el Anteproyecto de Ley durante el periodo de exposición pública- las bandejas destinadas a empaquetar productos alimentarios, que deberán ser compostables a partir de 2021, o los aros de plástico que sujetan paquetes de latas o botellas de bebidas, que deberán ser de material biodegradable a partir del mismo año. La desaparición de las bolsas de plástico de un solo uso, recogida en la ley, también ha sido avalada por la Estrategia del plástico presentada por la Comisión Europea. A partir del 1 de enero de 2021 sólo se permitirá la distribución de bolsas de plástico compostables muy ligeras, siempre que se destinen únicamente a productos alimentarios para prevenir el desperdicio y/o por cuestiones de higiene o seguridad. A partir del mismo año se deberá evitar la venta de productos que contengan micropásticos o nanopásticos y las versiones no reutilizables de encendedores, maquinillas de afeitar, cartuchos y tóners de impresora y fotocopiadora. The legislation features pioneering measures in Spain, which seek to combat problems that cause environmental havoc, such as littering in the natural environment. Balearic Islands Act 8/2019, of February 19, onWaste and Contaminated Lands sets ambitious targets in the areas of recycling, reuse, waste prevention, food waste, prohibition of single-use products… “The targets set out in the new legislation go further than those established by the European Commission. The aim is that, by 2021, waste generated will have been reduced by 10% with respect to 2010, through the implementation of these targets, and by 20% by 2030. To achieve this, it will be necessary to substitute many single-use plastic products with more sustainable alternatives. These include plastic crockery, drinking straws, cotton swabs for ears, and lollipop sticks”, explains Vicenç Vidal, regional minister of the Environment, Agriculture and Fisheries of the Government of the Balearic Islands. Other products have been added to these as a result of over 800 contributions to the Draft Bill during the period of public consultation, including trays used to package food products, which must be compostable by 2021, and the plastic six-pack rings used for cans or bottles of beverages, which will have to made of biodegradable material by 2021. The disappearance of single-use plastic bags, provided for in the Act, has also been endorsed by the European Strategy for Plastics presented by the European Commission. By January 1, 2021, only very light compostable plastic bags will be permitted, provided that they are used exclusively for food products to prevent waste and/or for questions of hygiene or safety. By the same year, it will be mandatory to prevent the sale of products containing microplastics or nano-plastics, and non-reusable lighters, shaving razors, and printer and photocopier ink and toner cartridges. By the same year of 2021, disposable capsules for coffee, teas, broths and other products used in coffee makers will have to either be made of compostable materials or be easily recyclable. Moreover, manufacturers and distributers of wet wipes placed on the market in the Balearic Islands will have to include information on the effects of these products on the environment. Similarly, municipal by-laws will have to include measures to prevent and minimise littering on beaches, including cigarette ends and packaging waste.
